§1. Postanowienia ogólne Niniejszy regulamin („Regulamin") określa zasady korzystania z aplikacji mobilnej Poradnik Kierowcy („Aplikacja") dostępnej w sklepach App Store i Google Play. Wydawcą Aplikacji jest Andrzej Gurazda, 03-553 Warszawa kontakt@poradnikkierowcy.com („Wydawca"). Korzystanie z Aplikacji oznacza akceptację Regulaminu oraz Polityki prywatności.

§2. Charakter aplikacji — bardzo ważne Aplikacja nie świadczy pomocy prawnej w rozumieniu ustawy z 6 lipca 1982 r. o radcach prawnych ani ustawy z 26 maja 1982 r. — Prawo o adwokaturze. Treści Aplikacji mają wyłącznie charakter informacyjny i edukacyjny. Nie stanowią porady prawnej, opinii prawnej ani indywidualnej konsultacji. Wydawca nie jest kancelarią prawną, nie pozostaje z użytkownikiem w stosunku zlecenia ani innej umowie o świadczenie pomocy prawnej. Każda sytuacja prawna jest indywidualna. W przypadku realnego postępowania (mandat, kolizja, sprawa sądowa) skonsultuj się z adwokatem lub radcą prawnym. Wydawca dokłada starań, aby treści były aktualne i zgodne z polskim prawem, jednak nie gwarantuje ich pełnej aktualności — prawo zmienia się dynamicznie. Stan prawny treści jest podany w Aplikacji.

§3. Wymagania techniczne Urządzenie z systemem iOS 15.1 lub nowszym, albo Android 7.0 (API 24) lub nowszym. Dostęp do App Store / Google Play w celu pobrania Aplikacji i otrzymywania aktualizacji. Aplikacja działa offline — nie wymaga stałego połączenia z internetem.

§4. Zakup i licencja Aplikacja jest odpłatna. Cena, waluta i sposób płatności są ustalane przez Apple / Google w sklepie z aplikacjami. Stroną umowy sprzedaży jest Apple Inc. lub Google LLC (zależnie od sklepu) — zgodnie z regulaminami tych sklepów. Wydawca dostarcza wyłącznie produkt cyfrowy. Zakup uprawnia użytkownika do nieograniczonego czasowo, niewyłącznego, niezbywalnego, niekomercyjnego korzystania z Aplikacji na urządzeniach powiązanych z jego kontem Apple ID / Google. Aplikacja nie zawiera zakupów wewnątrz aplikacji ani subskrypcji. Zakup obejmuje również wszystkie aktualizacje publikowane w ramach tej samej wersji głównej Aplikacji.

§5. Reklamacje i zwroty Reklamacje dotyczące funkcjonowania Aplikacji można zgłaszać na adres kontakt@poradnikkierowcy.com. Odpowiadamy w terminie do 14 dni. Reklamacje dotyczące transakcji (płatność, brak dostępu po zakupie, podwójne obciążenie) należy kierować bezpośrednio do sklepu: Apple: https://reportaproblem.apple.com Google: https://support.google.com/googleplay Prawo do zwrotu pieniędzy reguluje sklep, w którym dokonano zakupu, zgodnie z jego polityką. Jeżeli jesteś konsumentem w rozumieniu art. 22¹ k.c., przysługuje Ci prawo odstąpienia od umowy o dostarczenie treści cyfrowej na zasadach wynikających z ustawy z 30 maja 2014 r. o prawach konsumenta. Prawo to wygasa z chwilą rozpoczęcia pobierania treści cyfrowej za Twoją wyraźną zgodą (akceptacja warunków sklepu).

§6. Prawa autorskie Wszelkie prawa autorskie do Aplikacji, treści przewodników, wzorów pism, quizów, grafiki, ikon i tekstów przysługują Wydawcy. Zabronione jest: a) kopiowanie, modyfikowanie i rozpowszechnianie treści Aplikacji poza zakresem dozwolonego użytku osobistego, b) udostępnianie konta sklepowego, na którym kupiono Aplikację, osobom trzecim w celach komercyjnych, c) reverse engineering, dekompilacja, próby obejścia zabezpieczeń. Wzory pism możesz wykorzystywać na potrzeby własnych spraw urzędowych i sądowych — to jest ich zamierzone zastosowanie.

§7. Odpowiedzialność Wydawca nie odpowiada za skutki decyzji podjętych przez użytkownika na podstawie treści Aplikacji. Decyzje prawne podejmujesz na własne ryzyko. Wydawca nie odpowiada za: a) przerwy w działaniu Aplikacji wynikające z awarii urządzenia użytkownika, b) utratę danych lokalnych spowodowaną odinstalowaniem Aplikacji, awarią urządzenia lub działaniem użytkownika, c) działanie sklepów Apple / Google. Odpowiedzialność Wydawcy wobec konsumenta jest ograniczona do wysokości ceny zapłaconej za Aplikację, z zastrzeżeniem bezwzględnie obowiązujących przepisów prawa, których to ograniczenie nie dotyczy (m.in. szkód na osobie i winy umyślnej).

§8. Pozasądowe rozwiązywanie sporów Konsument może skorzystać z pozasądowych sposobów rozpatrywania reklamacji, m.in. platformy ODR Komisji Europejskiej: https://ec.europa.eu/consumers/odr. Sądem właściwym dla sporów z konsumentem jest sąd właściwy według przepisów ogólnych. W stosunkach z przedsiębiorcami — sąd właściwy dla siedziby Wydawcy.

§9. Postanowienia końcowe Wydawca może zmienić Regulamin z ważnych przyczyn (zmiana prawa, zmiana funkcjonalności, względy bezpieczeństwa). O zmianach informuje w Aplikacji oraz aktualizując datę u góry dokumentu. Prawem właściwym jest prawo polskie. W sprawach nieuregulowanych stosuje się Kodeks cywilny, ustawę o prawach konsumenta i RODO.

§1. General Provisions. These terms and conditions ("Terms and Conditions") define the rules for using the Poradnik Kierowcy mobile application ("Application"), available in the App Store and Google Play. The publisher of the Application is Andrzej Gurazda, 03-553 Warsaw, kontakt@poradnikkierowcy.com ("Publisher"). Use of the Application constitutes acceptance of the Terms and Conditions and the Privacy Policy.

§2. Nature of the Application – Very Important: The Application does not provide legal assistance within the meaning of the Act of July 6, 1982, on Legal Advisers, or the Act of May 26, 1982, on the Bar. The content of the Application is for informational and educational purposes only. It does not constitute legal advice, a legal opinion, or an individual consultation. The Publisher is not a law firm and does not have a mandate relationship or other legal assistance agreement with the user. Each legal situation is individual. In the event of actual proceedings (ticket, collision, court case), consult an attorney or legal counsel. The Publisher strives to ensure that the content is current and compliant with Polish law, but does not guarantee its complete validity—law changes dynamically. The legal status of the content is provided in the App.

§3. Technical Requirements: A device with iOS 15.1 or later, or Android 7.0 (API 24) or later. Access to the App Store/Google Play to download the App and receive updates. The App works offline—it does not require a constant internet connection.

§4. Purchase and License: The App is subject to a fee. The price, currency, and payment method are set by Apple/Google in the app store. The party to the sales agreement is Apple Inc. or Google LLC (depending on the app store)—in accordance with the terms and conditions of those stores. The Publisher provides only a digital product. Purchase entitles the user to unlimited, non-exclusive, non-transferable, and non-commercial use of the App on devices associated with their Apple ID/Google account. The App does not contain in-app purchases or subscriptions. The purchase also includes all updates published within the same main version of the App.

§5. Complaints and Returns: Complaints regarding the operation of the App can be submitted to kontakt@poradnikkierowcy.com. We will respond within 14 days. Complaints regarding transactions (payment, lack of access after purchase, double charging) should be directed to the store: Apple: https://reportaproblem.apple.com Google: https://support.google.com/googleplay The right to a refund is governed by the store where the purchase was made, in accordance with its policy. If you are a consumer within the meaning of Article 22¹ of the Civil Code, you have the right to withdraw from the contract for the supply of digital content under the terms of the Act of 30 May 2014 on Consumer Rights. This right expires upon commencement of downloading the digital content with your express consent (acceptance of the store's terms and conditions).

§6. Copyright: All copyrights to the App, guide content, letter templates, quizzes, graphics, icons, and texts belong to the Publisher. The following are prohibited: a) copying, modifying, and distributing the App's content beyond the scope of permitted personal use; b) sharing the store account from which the App was purchased with third parties for commercial purposes; c) reverse engineering, decompilation, or attempts to circumvent security measures. You may use the template letters for your own official and legal matters—this is their intended use.

§7. Liability: The Publisher is not responsible for the consequences of decisions made by the user based on the App's content. Legal decisions are made at your own risk. The Publisher is not responsible for: a) interruptions in the App's operation resulting from a failure of the user's device; b) loss of local data caused by uninstalling the App, device failure, or user action; c) the operation of Apple/Google stores. The Publisher's liability to consumers is limited to the price paid for the App, subject to mandatory provisions of law to which this limitation does not apply (including personal injury and willful misconduct).

§8. Out-of-court dispute resolution. Consumers may use out-of-court complaint resolution methods, including the European Commission's ODR platform: https://ec.europa.eu/consumers/odr. The competent court for disputes with consumers is the court with jurisdiction under general law. In relations with businesses, the competent court is the court with jurisdiction over the Publisher's registered office.

§9. Final Provisions: The Publisher may amend these Terms and Conditions for important reasons (changes in law, changes in functionality, security reasons). Changes will be notified in the App and by updating the date at the top of the document. Polish law applies. In matters not regulated herein, the Civil Code, the Consumer Rights Act, and the GDPR shall apply.
